If David Westerfield is innocent, why would he confess? Yes! He confessed to his attorney and his attorney was working on a deal to receive 25 to life the day BEFORE they found Danielle's body.

Jay, that is very interesting. Please explain how you know this "first hand." I assume you mean that "secondhand" would refer to reading it in the newspaper, or taking in other types of hearsay.

P.S. to "Jay". We would have to regard any "source" in the DA's office as hearsay and secondhand, consistent with the UT news report, which has been discussed elsewhere on this site.

I will always believe that David Westerfield is innocent. He does deserve a new trial.I will always believe that Vandam was involved.He was villified so bad,no wonder we will never here any more updates on the case.

My whole family watched this trial and not a ONE of us believe he was involved in this case. The whole family of Danielle's was tacky to say the very least. I think Westerfield was definitely the 'fall guy' here for many strange and different friends that the VanDams frequented. This man needs to be given a new trial and right soon before they carry out his death sentence!!! This Selby confession needs to be looked at CLOSELY and the 'unknown' DNA from Danielle's bedroom that was entered into CODIS needs to be checked against Selbys. Geez, if this were your father, brother, son, you all would certainly find loopholes. And ANY loophole is enough to exonerate Westerfield! Remember the old saying...'It is better to free a GUILTY man than to kill an INNOCENT man'. Someone needs to start some kind of petition to the courts or SOMETHING that will compel this case to be looked into again.

1. We know from all the published reports on James Selby that his DNA was already in CODIS before Danielle disappeared.

He might be best known as the tenacious lawyer who defended David Westerfield a decade ago in a death penalty trial that played out daily in a San Diego courtroom and on national television. Thank you for the beautiful post!

Welcome to Westerfield newsMy hero, Henry David Thoreau, tried to stay in the woods. One nasty social issue brought him out. Same thing happened to me. I am attempting to be a properly retired person, but the injustice of this wrongful conviction reminds me too much of the egregious Sam Sheppard case of 1954-1966. (I lived in Ohio then.)
